PLEASE PLACE BEFORE THE PRESIDING JUDGE ON RECEIPT - URGENT
We refer to the Defendant’s application to set aside (which we believe has been referred to the presiding judge, hence Ms Morris being copied in).
We would like the attached witness statement to be put before the judge deciding whether this application should be heard, or can be decided on paper. The statement should be read in conjunction with Mr Kallis’ first witness statement which is on the court file (but can be refiled if you wish).
The Defendant is in copy, by way of service of the attached.

I am writing further to the hearing in the above matter, yesterday, when I was given carriage of the order made.
I have drafted the order as per your dictation yesterday, please see the first two attachments (the figure for costs needs to be inserted into the final paragraph). I attach a copy of the Summary of Costs document for assessment, as discussed.
However, I would like to bring to your attention that the figure for the premium should correspond to the tribunal order dated 3 March 2024 (and the attached draft reflects that). I note that the Tribunal was asked to amend the decision, but my memory failed me as to it’s decision. I have attached Tarquin’s application and the decision in response (last two attachments hereto), which inter alia confirms no change to the premium.
