Dear Ms Morris,

We gather from the exchange of emails copied below between you and Mr Kallis since 12 February 2025, that the case may have been reserved to HHJ Johns KC as presiding Judge. Those email exchanges were never copied to the Defendants at the relevant time or since, in clear breach of CPR 38.9.

If that is the case, please note that we are happy to be served with any documents by email using the address in this email: 51dp@davylondon.net. The Claimants always knew this to be the case but never informed the court.

We would be grateful if you could update the Court records to reflect this.

Please note we intend to file evidence in response to the new statement from Mr Kallis by tomorrow morning.

I am writing further to the hearing in the above matter, yesterday, when I was given carriage of the order made.

I have drafted the order as per your dictation yesterday, please see the first two attachments (the figure for costs needs to be inserted into the final paragraph). I attach a copy of the Summary of Costs document for assessment, as discussed.

However, I would like to bring to your attention that the figure for the premium should correspond to the tribunal order dated 3 March 2024 (and the attached draft reflects that). I note that the Tribunal was asked to amend the decision, but my memory failed me as to it’s decision. I have attached Tarquin’s application and the decision in response (last two attachments hereto), which inter alia confirms no change to the premium.
